Your Representation and Warranty; Indemnity - By submitting content, you represent and warrant that you own the proprietary rights, including but not limited to the copyrights to that content, and that the reproduction, public display and performance, distribution and preparation of derivative works of that content by the North American International Auto Show or others will not infringe any third-party rights, including but not limited to, trademark rights, copyrights, moral rights and publicity rights or any applicable laws. If any person is uniquely identifiable on an image submitted, you represent that you have the agreement of that person to be photographed and to have that photograph published, and when and where required by laws, you have obtained a written release from that person. You represent that you are not under the age of 18 years old and you are otherwise legally competent to enter into this Agreement. You represent and agree that you will not upload, post, e-mail or otherwise transmit materials to us or our affiliates that contain software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment. You agree to defend, indemnify and hold harmless the North American International Auto Show and its present and former parents, directors, officers, employees, agents, affiliates and other representatives from and against any and all damages, claims, demands or proceedings (including but not limited to legal costs and fees) in the event of your breach of this representation and warranty and/or arising out of your submission of any and all content to naias.com.
Your License to the North American International Auto Show - By submitting content, you hereby grant to the North American International Auto Show a nonexclusive, perpetual, transferable, sublicensable, royalty-free, irrevocable, worldwide license to reproduce, prepare derivative works of, distribute, and publicly display and perform that content for any purpose and in any media, including without limitation by making that content available for downloading by third parties or by incorporating all or part of that content into other materials. You hereby irrevocably waive any claim based on moral rights, if any, in that content.
The North American International Auto Show’s Discretion in Accepting/Rejecting Content - The North American International Auto Show reserves the right to, in its sole discretion, accept or reject any content submitted for publication on this website, without notice or liability to you or to any third party.
Miscellaneous - This Agreement and the Photo Contest Rules will be governed by the laws of the United States of America and the state of Michigan, without reference to rules governing choice of laws. Any action relating to this Agreement or to the Photo Contest Rules must be brought in the federal or state courts located in Oakland County, Michigan, and you irrevocably consent to the jurisdiction of such courts. You may not assign this Agreement, by operation of laws or otherwise, without our prior written consent. Subject to that restriction, this Agreement will be binding on, inure to, and be enforceable against the parties and their respective successors and permitted assigns. Our failure to enforce your strict performance of any provision of this Agreement will not constitute a waiver of our right to enforce such provision or any other provision of this Agreement subsequently. The Photo Contest Rules (including all future changes) are incorporated by reference into this Agreement. This Agreement is in addition to, and does not supersede or modify, the naias.com Terms of Service Agreement.

1. HOW TO ENTER
a. The North American International Auto Show 2017 Photo Contest (“Contest”) will begin on Saturday, January 14, 2017 at approximately 9:00 a.m. Eastern Time (ET) and end on Sunday, January 22, 2017 at approximately 7:00 p.m. ET.
b. To enter the Contest, visit naias.com and submit a photo entry online as described below.
c. To be valid, photo entries must be taken on any day of the NAIAS 2017 Public Show, January 14-22, 2017
d. The North American International Auto Show, LLC (“NAIAS”) is offering early entrance to the 2017 NAIAS, at 8 a.m. through Hall C on Tuesday, January 17, 2017 only, for ticket holders with cameras who wish to enter into categories: Best Production Car; Best Concept Car; Most Creative Photo; and Ally "New Car Smell" Exhibit.
e. No excessive additional equipment, including lighting may be brought into the auto show.
f. Photos must be submitted in any one of the following categories: (1) Best Production Car (2) Best Concept Car, (3) Most Creative Photo, (4) Ally "New Car Smell" Exhibit. Regarding category (4) Ally "New Car Smell" Exhibit, Ally brought back its popular “New Car Smell” exhibit, located in the main Cobo Concourse, near the Joe Louis Statue. Ally will have ten fragrances on display this year that visitors can sample, and the company will also have a digital experience that offers visitors an opportunity to design a virtual scent for the chance to win a bottle of their own custom fragrance. Contestants must take a photo interacting with the exhibit to qualify for this category.
g. Contestants must fill out the Contest registration form with their name, e-mail address and the photo category in which they wish to enter their photo when uploading a photo for entry into the Contest.
h. Entries will be declared made by the authorized account holder of the e-mail address submitted at the time of entry. "Authorized account holder" is defined as the natural person who is assigned to an e-mail address by an internet access provider, online service provider, or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. All entries must be submitted with a valid e-mail account that may be identified with a natural person by appropriate independent means, including, without limitation, reverse domain name search. For purposes of these Official Rules, “receipt” of any online entry will be solely determined when the Contest Administrator’s website server records the entry data. Any automated computer form reply or receipt (such as one confirming delivery of e-mail) does not constitute actual receipt by Administrator of an entry form for purposes of these Official Rules. NAIAS is not responsible for online entries not received due to difficulty accessing the internet, computer malfunctions, telephone service outages, delays, busy signals, equipment malfunctions and any other technical difficulties. NAIAS is also not responsible for lost, stolen, misdelivered, incomplete or late entries, defective or unreadable entries, equipment malfunctions, technical problems relating to submissions or any other difficulties regarding the photo entries.
i. Photos submitted must be in JPEG format and must be at least 200 dpi. Any photo submission that does not fulfill these technical requirements will be rejected and will not be eligible to participate. Entries must be received by 7:00 p.m. ET on Sunday, January 22, 2017 to be eligible for judging.
j. There is a limit of one (1) winner per household.
k. Photographic entries must be the original creative photographic work and/or property of the contestant and may not contain copyrighted materials or any other materials, which may be restricted, prohibited or outlawed by federal, state or local laws. All photographic entries and their content become the property of NAIAS and will not be returned. NAIAS, at its sole discretion, reserves the right to disqualify and/or destroy any photographic entry if the entry contains illegal, indecent, pornographic, sexually explicit content or otherwise offensive material such as aberrational behavior, graphic violence or drug abuse, or if such photographic entry contains material whose content is deemed at the sole discretion of NAIAS to be unsuitable for public viewing or posting via the internet.
2. ELIGIBILITY RESTRICTIONS
a. The Contest is open to contestants with government-issued picture ID, who are 18 years of age or older at the time of entry. Employees of NAIAS, their parent, subsidiary and affiliated entities, their advertising agencies and participating sponsors/promotional partners and the members of their immediate families and/or households are not eligible to participate or win.
b. Winners must meet all eligibility requirements to receive any prize package.
c. Contestants are required to provide truthful information and the NAIAS will reject and delete any entry that it discovers to be false or fraudulent. The NAIAS will disqualify any entry from individuals who do not meet the eligibility requirements, and the NAIAS will also delete any entry knowingly received from persons under the age of 13 in compliance with the Children’s Online Privacy Protection Act.
a. Four (4) Prizes: Best Production Car: $150 Bose SoundSport; Best Concept Car: $150 Bose SoundSport; Most Creative Photo: $150 Bose SoundSport; Ally New Car Smell Exhibit: $350 Bose QuiteComfort 35. Winners also may receive the opportunity of having their photo highlighted on the NAIAS websites. There is no additional compensation for posting of winning pictures on the website.
b. All prizes must be picked up at the office of NAIAS, 1900 West Big Beaver, Suite 100, Troy, MI 48084 during business hours, which are Monday – Friday, 9 a.m. – 5:00 p.m. Prizes must be claimed within thirty (30) days of winning. Prizes not claimed within the stated time limit will be forfeited. Forfeited prizes become the property of NAIAS. In special circumstances, a prize may be mailed to the winner. If a prize is mailed, it will be with the prior written consent of the winner; and therefore, the winner assumes the risk of its loss. NAIAS is not responsible for the safe or timely arrival of a prize.
c. There are no substitutions, transfers or cash equivalents for prizes, except that NAIAS may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) announced at the time the Contest is run and do not include taxes, gratuities or any other expenses. Other restrictions may apply.
4. SELECTION OF WINNERS
a. Decisions of NAIAS management with respect to the Contest are final.
b. Winners: One winning photo in each category will be determined by the number of votes; the photo with the highest number of votes in each category at the end of the contest period will be deemed the winning photo. The person submitting the winning entry in each category will be deemed a Winner. If the highest number of votes in any category is shared by two or more photos, NAIAS reserves the right to select one winning photo in each category that best uses artistry and composition to best represent the category. Entries are eligible for judging only once. Photos cannot be submitted or considered for a prize in more than one category. Decisions of NAIAS regarding winners and entries are final. NAIAS will not discuss the individual photos for any reason after the Contest. Winners will be contacted via e-mail within 30 days following the submittal deadline. If the chosen Winner cannot be reached, no additional winner will be selected.
c. NAIAS reserves the right to not award a Winner in any category if no submitted entries satisfy judging criteria or if no eligible photos are submitted.
d. Prize winners must agree to satisfy all conditions and terms of prize established by the Contest sponsors, and must execute any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form before any prize is awarded.
a. Payments of all federal, state and local taxes, license or fees imposed upon the prize winners or the prize are solely the responsibility of the prize winners. The Winners may be required to sign an IRS Form W-9 or the equivalent.
b. By participating in the Contest, Winners agree to have their name, voice or likeness used in any advertising or broadcasting material relating to this Contest without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent prior to acceptance of the prize.
c. All profits from any sale of the photo will go to the NAIAS, LLC. The sole financial consideration for the entrant is the prize. Photos may be displayed at the NAIAS, reproduced in the official program and/or on the official NAIAS website, naias.com, at the sole discretion of the NAIAS, LLC.
d. Except as used by the North American International Auto Show, all entrants, including Winners, will retain the rights to their work. Entry in the Contest constitutes full permission to publish names and photos of Winners without further compensation. The determination of eligibility of entries and any interpretation of these rules is at the sole discretion of the NAIAS, LLC, and shall be final and binding upon all entrants.
e. By participating, the entrant agrees to abide by and be bound by these rules.
f. Prior to awarding any prize, NAIAS, in its sole discretion, may require Contest Winners to sign a liability release agreeing to hold NAIAS, its corporate licensee, its corporate parent, subsidiaries and affiliated corporations, and the officers, shareholders, directors, employees, agents and representatives of each of them harmless against any and all claims or liability arising directly or indirectly, including any physical injuries, from participation in the Contest or the Contest prize.
g. Failure to comply with the Contest rules may result in a contestant’s disqualification solely at the discretion of NAIAS.
h. The NAIAS, in its sole discretion, reserves the right to disqualify any person tampering with the entry process; the operation of the NAIAS’s website or is otherwise in violation of the rules. It further reserves the right to cancel the Contest for any reason, including, but not limited to, infection by computer virus, bugs, tampering, unauthorized intervention or technical failures of any sort.
i. NAIAS reserves the right to make changes in the rules of the Contest including the substitution of a prize or prizes of equivalent value, which will become effective upon announcement. If due to circumstances beyond its control, NAIAS reserves the right, but not the obligation, to cancel or modify the Contest and shall not be required to award a substitute prize.
j. NAIAS is not responsible for typographical or other errors in the printing, the offering or the administration of the Contest or in the announcement of a prize.
k. A complete copy of the NAIAS 2017 Photo Contest rules and a list of all winners (when complete) shall be posted at naias.com and a complete copy of the Contest rules shall be posted at the NAIAS during the event dates and during the regular hours of operation of the event.
